Park Yoochun Reportedly Faces Trial Over Failure To Pay Damages
Park Yoochun is reportedly scheduled for a detention judgment trial for failing to pay damages to the second woman who accused him of sexual assault (hereafter referred to as “A”).
According to a report by Ilyo Newspaper on March 26, Park Yoochun’s detention trial will take place at the Uijeongbu District Court on April 22.
In 2016, “A” was the second woman to accuse Park Yoochun of sexual assault at an adult entertainment establishment. At the time, Park Yoochun filed a criminal complaint against her for alleged defamation and false statements. “A” received a ruling of not guilty in both her first and second trials, and the supreme court denied the prosecution’s request for an appeal, solidifying the not guilty ruling. After being accused of sexual assault by four women, Park Yoochun was also found not guilty on all four counts.
“A” filed a criminal complaint against Park Yoochun in 2018 for compensation of 100 million won (approximately $82,010) and also requested that an officetel apartment owned by Park Yoochun in the neighborhood of Samseong be seized. Her lawyer stated that she was filing for damages because Park Yoochun had not appeared apologetic for his wrongdoings.
The court ordered Park Yoochun and “A” to settle over the damages suit through a mandatory mediation. According to the Ilyo Newspaper report, Park Yoochun never responded once during the legal dispute that lasted about 10 months.
Last July, the Seoul Court Mediation Center made a compulsory mediation decision that Park Yoochun must pay “A” 50 million won (approximately $41,060) in damages. The amount was solidified in September as Park Yoochun did not object within the deadline.
Park Yoochun continued to not respond, and his provisionally seized officetel apartment was put on auction for unpaid taxes. In December, “A” filed a request for specification of Park Yoochun’s property in order to collect the damages and the interest that has accrued because he did not pay it. Since he did not respond to this either, a detention judgment trial has been planned. It’s reported the trial may rule on whether Park Yoochun breached his duty to specify his property.
Article 68 (Court-Ordered Confinement of Debtor and Penalty Provisions) of the Civil Execution Act states: “Where a debtor has committed any of the following acts, without any good cause, a court shall punish him/her by court-ordered confinement for not more than 20 days, by its ruling: 1. Non-appearance on the date of specification; 2. Refusal to submit the property catalog; 3. Refusal to take an oath.”
After receiving a probation sentence last year for purchasing and using drugs, Park Yoochun recently started official social media accounts and announced the publication of a photo book. His reps have denied that he is planning a return to the entertainment industry.
